My Child Is on a Section 504 Plan
The Discipline is:
an expulsion*.
Response:
School administrators must give you written notification of the intent to expel your child. In the case of a proposed expulsion, you are entitled to written notice that contains a complete statement of the facts, a list of witnesses and a description of their testimony, as well as many other procedural rights under the Minnesota Pupil Fair Dismissal Act.1
A manifestation determination* meeting must then be held by a group of persons knowledgeable about your child, the meaning of the 504 evaluation data, and the placement options to decide whether your child’s behavior was caused by or had a direct and substantial relationship to his or her disability.
If the behavior in question was drug or alcohol use, the school can suspend or expel your child, just as it would a student without a disability. For behavior involving drug or alcohol use, a manifestation meeting is not required.
