My Child Is on a Section 504 Plan

The discipline is:
- an out-of-school suspension.
- an expulsion.
- an in-school suspension.
- a suspension from the bus.
- being sent home before the end of the school day.
NOTE: Neither the Statute nor the regulations in Section 504 provide explicit disciplinary provisions. As a general rule, the Office for Civil Rights (“OCR”) has interpreted Section 504 to include similar disciplinary protections as those provided under the IDEA. However, OCR decisions are not often consistent and sometimes in direct conflict. In addition, the case law is not very well developed. As a result, the statements regarding Section 504 should be viewed with caution as it is difficult to make clear statements about students’ rights in the absence of a statute or rule establishing those rights.
